    How do I go about taking parental rights away from a 'father' who can't be found?
    I'm wondering how I get my ex-husband's parental rights taken away. He has not seen my son or contacted me about him since Sept. 2005 and has not paid child support since then either. I have no idea where he is and currently he has a warrant out for his arrest because of failure to appear in court for a violation of probation(because he's so far behind in child support). I'm just wondering how I would go about getting his rights taken away... cheaply, I can't afford a lawyer... so if there is something I can do, something to file myself... I'd appreciate any advice.

    Why? Do you have a new partner that wants to adopt?
    You can go back and get full legal and physcial custody ( but assume you already have that) and can try. But it is not easy and personally don't know why, if he is not there he can't do anything anyway.

    I don't know about all states but the cases I've seen in my state a lawyer is required. There are many times that a judge won't grant a TPR but in the cases that I have seen he required one of the parties to get a lawyer (he didn't care which party) to draw up final paperwork before he would sign off on them.
