In South Dakota do you have to have your parents consent?
Hi, I live with my dad and my step-mom. I recently got kicked out of my apartment. I moved out in February, and I lived in an independent living program, called Stepping Stones. Well, I didn't come home one night, and I got kicked out. My dad called me in as a runaway, and my brother found out where I was staying. I want to get emancipated because I don't feel safe in my house. A couple years back my dad beat me up, and since then and before that he hits me. I don't feel safe, my step told me on June 1,2008 that I wasn't welcome there .now all I want to do is get emancipated, but I'm afraid that if I try to leave he'll call me in as a runaway. Now I just don't know what to do. So if you could please help me before I do leave without planning it out?

How is your dad and brother with you. I mean are they loving and caring. If they are, then why should you at all think or plan to leave them?

You have to file a petition in Family court for emancipation. They can tell you what requirements you will have to meet.

My dad's the one who beats me, my brother all he does is pick on me, and all we do is yell at each other. He'll hit me if we yell enough. No one in this house likes me so why bother staying here. My step-mom flat out told me that I wasn't welcome here.

Depending on your age (a lkey piece of info here), your father and step mother may not have a choice. If they just arbitrarily kick you out, they could be charged with abuse. However it sounds like you have been placed in halfway houses and blew those opportunities. If I'm right about that, it won't help you get emancipated.

To get emancipated you will have to prove you can live on your own. This means getting a job, a place to live, etc. It's a long uphill battle.

I understand the situation that you are facing, which is really bad in deed. But they are YOUR'S may be step-mom isn't. Your dad has a heart which knows that he gave your birth and life. And he will understand your situation. It is left to you how you make him understand that you need him. Parents love their kids, probably there must be some reason for beating you. May be not from your end but other reasons.
Life shows all it's faces while one is alive. Life is all about how you fight when you have a bad time. Your life and your family members weren't the same all time. Anywhere you go you just can't get rid of the attachments and the relation that you are sharing with them. You just can't get away from them, because you might feel your dad is too bad, but the truth must be something different.

I'm sorry but that is just a bunch of hogwash. The cemeteries are full of kids whose parents "loved" their kids to death! There are thousands of cases of abused and neglected children. There are people who were never meant to be parents. There are cases where parents feel little or nothing for their kids. Lets be more realistic in giving advice here.

I would suggest you to better go by a softer way and think from the point which I have put forth.

And I suggest you take off the rose colored glasses and try to see the reality of life. There are people who do bad things. People can get seriously hurt if they try to give people too many chances.

Actually Scott you are being too nice, that post was so much bull I had to use air freshener just from reading it.
No child or person deserves to be abused, and when the parent is the one that does the abuse, they are criminal and there is no love. A person who loves you does not abuse you, PERIOD>

The person being abused needs to call children and family services and if it means foster homes he needs to get out.
Plus remember when you are given chances, you have to follow the rules or you pay for your actions.
