    Life insurance claim after discharge
    I filed a chapter 7 bankruptcy the end of jan 2008. I got discharged and closed may 13, 2008. My father lives out of the country and I just found out that he passed away. I was checking all his documents and I found a life insurance policy leaving me as beneficiary. Can I claim this and keep the money? There is no estate as to he wasn't living here in the united states. He only had this life insurance policy. Do I need to wait 180 before claiming or is it OK to claim now since it's the bankruptcy is discharged and closed. I live in GA in case that might matter. Thanks!

    Well this is tricky, since if he died during the time frame of the bankruptcy then the money was suppose to be declared. And a if a debtor is still watching you, a large amount of money into your bank account may draw interest.

    If you are the named beneficiary then it would not go into an estate,

    I would wait if it was me, or have the money put into a non US bank.

    So wait the 180 days after the filing date of Jan 2008? If so, that will be the end of July that I can claim. Also the ins company has where they will put the money in their account and they will send me checks and I can do with the money what I want.
