:confused: I am buying a home for my mother. (mobile) she lives in my grandfathers old mobile home and when he was put into a nursing home years ago the state took all his property to support him and his social security. At the time 15 years ago the trailer wasn't worth anything so the state didn't take it or make her move. When she moves who is responsible for the fee of the home disposal? (required by the trailer park) The park charges $2,000 to pull out the trailer. She is not the owner and it is the owners responsibility for the fee.
Where do I go to find out who the title belongs too. We have a copy of the title and it still has my grandfathers name on it.

I don't think the state took the trailer 15 years ago. I think they put a lien against it. I say that because I don't think they can take the home away from the spouse of the one that is in the nursing home. It could vary in diff states but what they would be doing would be helping the husband with nursing home costs, and throwing the wife out on the street. There are some very complex rules and regs about qualifying for nursing home assistance through states and Medicaid. Please check with an elder law attorney but I think your mother will have to sell the old trailer for someone else's use or sell it for scrap, or if that is not possible get rid of it through the disposal method. Either way the state will claim the money she gets for whichever sale (and maybe that's zero). The state agency or county is required to seek reimbursement of funds expended toward the person's nurs home care. I certainly could be wrong but the state is looking to recover money, not spend it on the disposal fee. I apologize if I have confused the issue. I am not a lawyer but we got very involved with this issue with my mother who went into a home and has since passed away. They put a lien on her house and did nothing else while she was alive but once she passed away and the house was sold, they took all the proceeds from the sale. Maybe the state agency can answer your questions or find an elder care lawyer who will agree to answer a simple question for a reasonable fee, say $ 175. The attorney I dealt with would get to the bottom line on this issue in 10 minutes, but he prob charges
