My son bought my mothers home over a year ago, she now pays him rent. My 42 year brother has been living with her for seven years, has not worked during this time, does not paying any room or board and refuses too. She has tried for years to get him to move, but she is afraid of him. She has had to file bankruptcy and can no longer keep him up on her social security. He has been trying to get on disability, and has been turned down before. A free clinic Dr. has told him he could get him on disability, but it would take four years. I think the only thing wrong with my brother is laziness, but he is on meds for depression and has been for a year. He never has worked more than a year at a time, usually he would work 8 months then not work for a year. How can she/ we get him out?

It is easier if the son who owns the property merely evicts him, since he is the owner. He gives him a written notice, and then if he does not move the son takes him to housing court.
