    One month left and our house is being foreclosed on
    So about a month ago we started having people stop by and leave foreclouser information on the door. We had gotten a call about five months ago and they said the house was being foreclosed on. So we called our landlord and he said that it was taken care of. Last Friday we had a letter left on the door we called the number of the real estate company the lady said we should not pay rent June is our last month we must be out on the 30th. My real question do I have to pay rent?

    You have to pay legally to the legal owner, so at what point will ownership transfer? So you will owe someone rent till you move out.
    Now normally the last month you are there, many don't, since they realise they will never get their deposit back if the person is in foreclosure.

    But if you have to be out by May 30, then no you would not pay June.

    If you are a tenant, you owe rent; there seems to be some question as to if and when the foreclosure took place, if at all; it is not uncommon for property to be scheduled for foreclosure (by auction), and then the auction is postponed for some reason or another, such as the owner promising to catch-up past due payments or filing bankruptcy. The rent is owed to someone, but you may want to place it into escrow until you know who you owe.

    Not sure what state you're in - the right answer varies state to state. Yes, you do have to pay rent UNLESS THE LANDLORD AGREES TO WAIVE IT (Get that in writing). If they won't waive the rent, pay it into escrow. Later you can sue for damages - (moving expenses, deposit, etc) and at least the judge will be able to award what you paid into the escrow account. Hope this advice helps.
