I am an unmarried woman with a 2 month old baby. The father & I are not together. He sees the baby a couple times a week, when I am with the child. He does not have items to care for a baby at his house. I have not filed for child support, he told me that he would pay the amount each month without having to file. I am returning to work this week & he has just said that he thinks he can pick up the baby from day care whenever he wants. I am not comfortable with this. Is there anything I can do to prevent him from taking him every day if he chose to? How much is he allowed to see him when I am breastfeeding? How do I go about getting a parenting plan if I can't afford an attorney? Please help.

First off is he on the Birth Certificate ? That answer is what a lot depends on for your given situation. Another thing is that for both of your protection you need to go to court and get things in writing. Visitation and support. In the long run nobody can predict what the future is going to hold. Also had you been together wouldn't he be allowed to pick up the child from daycare anyway ? As far as breast feeding goes your not going with the baby to daycare so Im sure your making other arrangements to be available for your child and he too can adopt to those also.

As much as the court can give the mother more while the child is under one year and she is nursing, by going back to work with the child in daycare you just killed the whole breastfeeding argument. You will have to go to court to get the visitation schedule and support order so that you can develop your parenting plan.

What visititation the father is allowed depends on what the court feels reasonable. I doubt if there are any statutory rules here, its generally left up to the court.

I'm suspicious when a father says they want to avoid the courts. Doing so, gives all the advantages to him. In my opinion you can't afford not to have an attorney.
