How many days can a mother leave her children with no contact before it is abandonment?

I do believe it varies from state to state. Where do you live? Are you talking about yourself or the other parent? How long has it been?

Why is she gone, ( that is the first issue) and why is there no contact ( second issue) But some states have the years required for no contact to be considered but in the US it varies by state.

And still why? Is it to gain full custody, is it to ask for more child support, what does one wish to gain by claiming this

It is my sister in law's kids. She has seen her 3year old son once in the last 2and a half months. She has seen her 6year old daughter maybe 3 times in the last two or three weeks. She does not call them at all. She is moving here to Little Rock, Arkansas from Missouri. She put here daughter in school in Conway, she is staying with one of her mothers old friends. Her son is with his grandma. She stayed at my house for almost three weeks and she saw her son once because my husband told her to go get him. No one can take them to the doctor or anything. She got her daughter inrolled in school and them missed her first day. The lady that is keeping her didn't know who her teacher was or anythig. She left for Missouri last Sunday and came back Friday and is planing on leaving Monday. She wants to go to River Feast and is spending time with her boyfriend, and has yet to contact her kids. They don't know she is here. The oldest one talks about how much she misses her mom and she prays for her every night.

In most states with children that old it has to be a full year with no contact. However because of the parties that the children were left with it might change it a little. Still though the better bet would be to call children services or child protection (same thing different name depending on where you are). Explaine the entire situation to them and they can open a case to investigate and the proper authorities will be informed.

It really depends on the state laws. Many state websites have the statutes online and you can read them. This will give you a better idea at what you are looking at. For instance in Texas.. Abandonment is 31 days, however the parent can come and get the child at anytime even with a notarized power of attorney. You have to wait 6 months to get temporary custody granted through the state court unless you can prove an emergency situation and then it can be sped up if the judge feels that it is an emergency.
