    A dimissed case comes back
    Hi,
    I had a credit card sueing me. Court date jan 2007 I showed up they didn't. Won a case with a dimisal without prejudice. Today I get a letter from a collection agency coming after for the same thing. Can this happen.? Its been well over a year since the court date.
    Do I answer with this has been dismissed in court or ignore it.

    Was dissmissed without predjuce meaning that they can sue again. Sorry that your case was not dissmissed as you thought

    Yes, that is exactly what it means, so yes they can re-file their case.

    Not clear what you received, but a debt NEVER expires. As noted a dismissal without prejudice allows them to file again. Their original filing would extend the statute of limitations. So if they want to resubmit the suit, they can. If they want to dun you for the debt, they can.
