    Probation rights violated?
    :( I was wondering about my fiance's rights. He got a drunk driving and is in jail. The judge issued a 200.00 signature bond. All good but then his probation officer stepped in and held him. Ok, fine. The only thing is, he wanted to revoke himself and get the paperwork done so as not having to deal with her anymore. She said it would take ten days and then he could put in a request for a ferlow. You see, in six days now, I am going in for a c-section. It is his first baby and his probation officer refuses to let him attend the birth. Just out of spite. She is sitting on the paperwork and drawing this out knowing that he will miss it. He is my only support person and he isn't even a repeat offender or anything. Everyone including most of the jailers think it is ridiculous. She even called me and was rude to me. We need someone to hear our request and understand our rights. We don't know what to do next. I talked to my doc and may be able to push the c-section ahead a few days but due to my health in this pregnancy, I can't go into labor on my own. My question is what are his rights, who do we talk to next, and how do we make a complaint? The papers are already signed to get him off probation, she just isn't sending them in. Help please! Not much time left and I need him there! We even heard of someone who was sitting on his fifth drunk driving and he still was let out on a ferlow for two days for a wedding! But he can't attend his son's birth! Ridiculous.

    You won't be going into labor if you have a c section for starters. A c section takes that out of the equation if you have the date planned. Some probation officers do as they please. Have you tried contacting anyone at the probation office such as a supervisor and ask them why the paperwork has not been submitted? Basically what you insist is his rights, I'm confused about this statement. You said he revoked himself so he doesn't have to deal with the paperwork any longer. When a person is in jail the probation dept can take their sweet time in doing whatever they wish with the paperwork. Just because you are having a baby is not an earth shattering reason for them to move any faster. You'll just have to get over this fact if after you speak to the probation office supervisor and they deny his release or furlow as you put it to attend the birth. You can't compare someone else attending a wedding. That's just hersay - you don't know for sure. Go to the supervisor for clarification on this.

    It's true, the probation officer sucks... But, your husband doesn't have a "right" to a good probation officer. He gets what he gets - and we all get the same thing.

    You did not say what he was on probation for, and if his probation is revolked, he will go to jail for this, and sorry but most jails I know don't let you out for the birth of a child.

    And to be blunt, when he was arrested for DUI, he gave up all his rights, since he showed no concern over the safety of others. And I think you will find that, with many people in the court systems.

    So at this point, he needs an attorney to be in there trying to get things done.

    All you can do is speak to the probation officer to see how long they are going to hold him and try to convince her of your needs.
