    Wife won't sign lease in Florida
    I am in Florida and found an apartment, I signed the lease but upon seeing the property my wife found a number of issues that are not easily resolved and refuses to sign the lease. Already gave them a security deposit and first months rent. Lease is in both our names, which is what the manager required.

    My "move in cost sheet" listing fees costs and such gives me the right to back out in writing within 72 hours of signing it as long as it is "prior to the execution of a lease agreement." If she has not signed and the managers have not signed do we have an executed lease agreement?

    We are not scheduled to take possession for another week, What can I do?

    I expect one answer will be to reason with my wife... have not been able to figure that one out for the last 8 years, probably not going to happen now.

    Well of course having enough sense after 8 years not to sign for a home without her seeing it first. But at this point all you can do is try, if they don't agree you will have to take them to small claims court

    Agree with FrChuck.

    If it's a lease in both names and you both didn't sign, I don't think it's a legal lease. Try to "break it" and if they don't agree, well, then you go to Small Claims Court.

    Or you could live in an apartment your wife hates - assuming she'll even move in - and then post your next question in the Family Law section. This will make for some great family dinners at your house.

    If the lease is in both names and she does not sign there is no lease consummated then. If you want to back out - back out quick before anyone tries to stop you. After 8 years if you haven't figured her out, don't even try. It's too late.
