    Can a room mate that's not on the lease just move w/out notice?
    Hello group I was involved in a situation with a room mate / longterm friend "asked" me to be there room mate and my aggreeing to it. The thought sounded pretty nice besides we have been friends for over ten years, so we go apartment searching to only find out that she can't be on the lease even with a Co signer she can't she owed another property me on the other hand I have Great credit and was approved for every property we went to the properties also informed me that she couldn't be on the lease nor live with me Yikes! She was my friend and I enjoyed her we laughed and had tons of fun so I found an apartment that we both agreed on that was brand new and affordable we didn't require a dep. Well I didn't based upon credit so it saved us both some mony plus the frist month was free so it was a go getter I never informed this property that she would be living with me because of the credit reason with that being said we moved in and me being dumb never got a written agreement between the two of us. Well maybe three months into the lease her sister has an altercation with the grandparents and he puts all three of her other sisters out and guess who's door step they are on? NO... NO... NO... I said but I gave in they were horrible light bill increased and water and also may I include 217.00 in paperview charges We had issues so I approached her about it she went off so I left it alone with that being said she flipped it around on me and said she was moving out without notice and said this is your lease I'm not on it and I'm not obligated to pay anything else when I came home that night she had packed and moved all of her things what am I to do with 3k left of her half on the lease total 6k with my half can I get my money from her legally help me I'm a college student with great credit that I want to keep I don't want to charge the rest on my credit card.

    IF she agreed to pay rent, share in the rent, whether she's on the lease she was your tenant and you can pursue her in Small Claims Court for anything she agreed to pay but did not pay. Your landlord cannot pursue her for anything that is unpaid and can only go after you.

    It will be your word against hers as to what the financial arrangement was.

    Well you may have an issue, if it was not legal for you to sub rent to her, you may not be able to collect from an illegal rental. But you can try, but then you will have to admit she lived there along with the rest of the family. So when this comes out in court, could it get your evicted also?

    You have to realise that is a reason her credit is so bad, not paying her bills, and this is another example.

    So at best she was on a month to month unwritten rental. Sinice normally a actual lease is required to be in writing. So you may get her share of the rent for current and next money ( in my opinon)
    But then her defense would be that you had no legal right to rent to her, it was a illegal rental, and could perhaps even ask for all her rent money back since it was not legal for you to rent her her.
    ** depends on what your lease says about subrenting
