Hello I signed my lease Aug 2007 for one year, The house was in really bad conditions, in Nov. I got mold in the air conditioner unit and my daughter got allergy, I complain a lot of times with the manager and finally I wrote a mail, in March, and they came. I decided to buy a house, I will not have this problem the house will be mine and I will fix it, and finally I did it, I gyved a notice of 45 days they told me that they will charge me all the expenses and until they will not rent again the unit. What I can do?

If you can prove that the problem with the mold caused you and your family medical problems, you probably would win this is a small claims court. If you are just moving because you want to get out of there and have no real reason, you can be held to the terms of the lease. Get the medical paperwork together and then talk to a lawyer,, even the one that is handling the purchase of your new home.

Have you documented the mold, called in the building inspector, the city code enforcement people, do you have alll the documents you mailed to them to show you complained.

I have the doctor's certificate and all the mails with the recives that I sended, I have the pictures too, no I didn't call any inspectors at that time.

Part of the trouble will be, if they sue, you are no longer in the home, will they say you caused the mold ( where is it) and so on.
Also photos will show stains on the walls, but not reallly proof it is mold, so that is where inspections from city or county inspectors and a written report is proofin court. Remember it is your problem to prove there really was mold there, and next you willhave to prove the mold was above allowed limits. Remember there are min limits that are allowed, I am not sure the parts per million, but without testing you can not prove there was enough mold in the air to be a problem.

Ok, may a court allow you to win with just photos, yes because sometimes they are pro the renter. But not always.

Declare the following: The 10th of August 2008, we moved into the apartment no. 37 which was in pathetic condition. We found that it was unacceptable due to the dirty, degenerated condition. In consequence we brought this situation to the attention of the manager of the complex. After many requests that our rights as renters be observed, we found ourselves, after two months, with only an unacceptable amount of the repairs completed. Therefore we are still living with the numerous problems we originally found in the apartment. Since February 7, 2008, our family is without an oven or a dishwasher, of which the latter has a new replacement that is sitting in the garage with no reason as to why it has not been installed. On November 15, 2007, we presented our most pressing problem to the manager, that of the black mold in the air conditioning unit. We presented it with photographic documentation due to the obvious importance and immediate necessity to be addressed as a serious health hazard. Our complaint was answered by a superficial vacuum cleaning of the mould without the intervention of a specialized service which this problem necessitates. The result of this lame attempt to pacify angry renters is that our daughter was diagnosed with a rhinitis allergy caused by the mold and dust from the air conditioning unit (medical documents are attached). The precarious living conditions are no longer sustainable considering that the health of our children is now at risk.
The condition of the apartment has been brought to the attention of the manager innumerable times without any acceptable response. Therefore, with this letter we are communicating that as soon as we find a new living arrangement we will leave the present one. We will communicate our eventual move in a time of no less than twenty days. In the meantime, considering we are in unliveable conditions, we once again request immediate maintenance attention. We are also enclosing photos of the air conditioning unit to demonstrate what our family is breathing daily. If requested we can give a detailed list of all the problems and unacceptable conditions found in the apartment at the moment we moved in. In the event that we do not receive a reply within seven days, we will proceed with legal action. We respectfully request your prompt attention to this matter.

They came yesterday with a vacuum cleaner and they said that was a mold test, I'm not stupid, 5 second for a test? And near the door? But the problem is that I will go away for the mold, and for the sickness of my daughter, of months ago, after my mail they cleaned and they didn't send me anybody for the test or any mail in response at that time.
