Room mate stopped working & paying.
My "boyfriend" & I both signed a lease in Feb. 2008. We both work for his father and we are suppose to be taking over the family business. He has stopped going to work, his father is on the verge of firing him. He refuses to look for other work. He is not contributing at all. I can not afford to pay the rent & bills alone. (I am a single mom & my sons father refuses to pay child support.) I have enough saved to pay the rent in the beginning of June but after that I'm stuck. I need to get him out & get a another room mate however he refuses to leave stating he "signed a lease he's not going anywhere."
I don't want to lose my home or my security deposit. (Half of it is mine) I also have no where else to go. What can I do?

    Hello stressed:

This is kind of like you co-signed a loan... YOU are stuck paying BOTH shares because if you don't, YOU'LL be negativly effected.

You can certainly sue him for his half and I'd try evicting him too. In some states, those procedures are one in the same.

Eviction is your best option but without a new roomie you are still in hot water. Your other option will mes up your credit a bit but you could stop paying rent too. The LL will take some time to evict both of you, likely later than June. The LL will probably sue both of you for the lost rent until he can rerent. In court the judge will hold you equally liable, probably, but it's a crap shoot.
