Is there a time limit on a law suit being filed after a memorandum of lis pendens has been filed in Virginia lis pendens was filed 5/3/07

I haven't found any specific statute of limitations in Virginia but I did see that there is an obligation that the suit be filed in a timely manner. I would think that a judge would not consider one year to be timely.

You have to make a motion to the court that the lis pendens be discharged due to their failure to file suit. You may also consider suing the people who filed it for any damages you may have. I suggest that you speak to a real estate attorney about this before taking any action.
