    Husband and Wife being Residents of two different states.
    My husband and I are both retired and 58 years of age. I just bought a home in Florida. The home is under my name only. I will be living there about 7 months of the year. My hubby and I have a home in Wisconsin also. He wants to stay a resident of Wisconsin since he will be there at least 8 months of the year. Since I am going to be in Florida most of the time I want to be a Florida resident. Can you advise me if we can legally do this ? It will be beneficial for my hubby to stay a resident of Wisconsin because of the out of state costs of Fishing and hunting licenses. Can you advise me if we can be residents of two different states, I in Florida and My husband in Wisconsin?

    Generally your state of residence is where you spend the majority of the year.

    Yes, you can, there is no tax requirement that husband and wife actually live together, merely be married if they are filing jointly.
