About how long does it take to have your record expunged? And are there any reasons it wouldn't go through if all requirements have been met? The paperwork was never filed by an attorney, the court had information on how to do it on the website without one... was it wise NOT to use an attorney?

It all depends on just how long ago the conviction was for starters. It also depends if you included all the proper paperwork required. I've seen expungements for felony cases take up to 9 months to go through. It's not an over night process either. If you are that anxious to see where the process is in your case you can call the Clerk's office and ask them if a hearing has been set in the matter yet or where the case is at now. You might be missing a crucial piece of paper. Who knows?

You have to first apply for a explungement in the court where you were convicted, In most areas you will have to wait for 8 to 10 years from either the date of the convition or date you were off probation or parole.

And the judge can just say no, he is not required to grant it. Some judges never accept any, others accept most. So your local attorney will normally know what your chances are.

They often look at if you have held a job all of those years, if you perhaps went back to school and changed your life around. They most certainly will expect no other convictions during that time.

I would not try it without an attorney since they kmow more of what the judge will be expecting to see, and to hear from you.

As for as time frame, yes months from time you file.

You have GOT to be kidding me? I thought if I completed a treatment in lieu of a conviction and it was dismissed it would be a no brainer. I filled out everything that was required according to the internet sight and the clerks office. UGH! I want a job.
