    Relinquishing a father's right
    Hi I live in NYC and I'm the mother of a 7 year boy. His father is not in the picture he went in jail and was deported back in 2002. Since then we have not heard from him. I do have a contact telephone # for him, but he refused all my calls and want nothing to do with his son. Can I relinquish his rights? If so how can I go about doing this? I'm single and I have no plans of marrying in the future. I have a will stating should anything happen to me my sister would have custody of my son. The reason I would like to do this is because should the event something happens to me, I don't want the "father" to get access of my son's assets.

    You will need to hire an attorney or go though legal aid in your area and file a motion in court. If he went to jail for a felony and the fact he was deported may be enough.

    As said you have to go to court. The judge may grand the termination based on the fact that he was deported after going to jail. But just to give fair warning the judge may also want there to be an attempt to contact the father made. You will also most likely have to hire a lawyer just because I have yet to see a judge grant this kind of motion with out a lawyer drawing up the papers.
