I am filing for a divorce from my husband with whom we have been married for over a year. He has been very good to my kids and played a fatherly role during this period. I cought him cheating on me which he does not want to admit. I am sure he will pay allimony until the divorce is over with. Can he be asked to pay child support during this time also?? Why would he pay child support for a child that is not his? The children's father(s) should be taking responsibility for them. Probably no is the answer you are looking for

The kids are YOURS, not HIS... so the answer is NO.

If the children are not his, and if he has not adopted them, you have to collect child support from their bio father.

He will never have to pay child support for kids that are not his and that were not adopted.

You may be able to get a temporary alimony until the divorce is final. The judge would have to determine this if he does not agree to paying this. No, you cannot get him to pay child support if the kids are not his. Sorry.

Most of these things would be filed by an attorney.

Spousal support is typically determined by the length of the marriage, if he provided a certain lifestyle - say you didn't work and he supported you 100%. But only being married a year - I would not expect much or really anything at all.

I would talk to an attorney to guide you through all of this.

Alimony or spousal support is not always a for sure, In fact most divorces I know of there is none. It will depend on many factors from wages earned, wages earned before marriage and how long they were married.

If I am understanding your question correctly, He does not have to pay you child support at all and alimony would be for a brief time only...
