You can't sue for pain and suffering. Pets are property. The law doesn't consider pain and suffering in property or contract cases. Sorry, but that's the legal realities. You may be able to accuse the owner of negligence, but that wouldn't increase the amount that you can sue for. It would be the grounds on which you were awarded the compensation, instead of it being a comparable liability case.
And, of course, there is always the problem of getting the money after you have the judgement.
Not saying that you shouldn't do this... just be prepared for the real possibility that you go through it all and still wind up without a cent.
