I would like to gain legal custoday of my niece who is living with her father. Neighbors are reporting that she is being left alone a lot and question the supervision provided by the father. She is 11 years old. Where do I start. Her mother died of breast cancer and had divorced the father 6 years ago. She custody of the children with the father having visitation.

You would have to go to your local Family Court and petition for custody, citing all your information and present evidence that the father is unfit or a risk to the child.

If he's in over his head he MIGHT agree to sign over custody but I wouldn't count on it - might be worth asking him but I'd leave the neighbors out of it.
