Depending on how long he's been there, what HE says your agreement was, how interested the Police are in trespassing (and that's a difficult charge to prove if you've known he was there) you will have to evict him.

He's in there BEFORE you reach an agreement on the amount of rent he is to pay? I think this was a disaster waiting to happen. You don't need a lease - he may say it's a month to month arrangement.

If he has done any work on the property at all you will have an argument - what was your agreement? How long was he to do work before moving in? Did you give him the keys? Did he have the utilities turned on? He could claim against you for work he did before you evicted him - if you evict him.

Need more info to really be sure.
