    Answering a summons
    I recently was served with a summons for a credit card debt I had with Discover Card. The debt is valid but I would like to work out a payment plan. When answering the summons would I request the payment plan I want at the end of my answer. Similar to that at the end of the summons from the collection agency where they state something along the lines of "The plaintiff requests payment in amount of..." Only I would state "The defendant requests a payment plan of $200.00 over the next so many months...." ? Or do I have to go to court and plea the payment plan to a judge? If I agree to the complaints do I still have to go to court or will this be handled out of the courtroom? Any help or suggestions are welcome.

    10yrs or there about I received a credit card, unsolicited, I was working at the time, and excepted this card with the intention of paying off anything I used this card for ! I paid at least the minimum every month, until I became disabled and was unable to pay off this loan ! Though I tried, I disputed some of the charges on this card, through writing and never received a response from the credit card company ! The next thing I know I'm being summoned to court, my dept was sold off to a dept collection agency and they wanted me to pay them, I told this law firm, about my request for the bank to send me a copy of my purchases using their card and never received it! I am totally disabled now, and receive only $350 a month to live on! What's my obligation to the collection agency .
