    How long will consular officer review for k1 visa applicant
    Hi I'm tina applicant of fiancée visa in us embassy manila

    This is the reply of the embassy on our inquiry for my case:

    The case is still under review by a consular officer. As soon as the review is completed, we will contact the applicant to resume processing the visa application.
    We want to assure your constituent that, while an approved fiancée petition is originally valid for four months from the date of approval, it may be revalidated by a consular officer for an additional four months. This revalidation is routine as long as the petitioner and beneficiary remain legally free to marry and plan to do so within 90 days after the beneficiary enters the United States

    How long will it take?
    And they mention about revalidation
    Do they implied in case I am denied by them is my application can be candidate for revalidation?

    Normally, a petition approved by NVC is valid for 4 months but in some countries the consulars need more time due to work load. So it means, the process may take longer than 4 months but it does not mean your petition is denied. In the Philippines, Viet Nam and a few other countries, it take between 10-12 months. Nothing to worry about as long as you and your b/f are in relationship.

    If your case is denied, you will be notified at the interview. Good luck.

    How to challenge the us embassy consular officer's decision?
    I was interviewed at the manila us embassy last April 2,2008 and the consul told me that he can issue me a visa because my fiance's 2006 Income Tax Return didn't meet the federal level of poverty guidelines.I understand. At that time my fiancé still don't have the 2007 ITR.. the consul told me I can challenge his decision anytime if I think I can prove that I will not be a public charge and if I have a proof... now my fiancé have his 2007 Income tax return, I went to a attorney before I passed the ITR 2007 to the us embassy to make sure it meet the guideline and according to the attorney the ITR 2007 is enough plus the bank statement of my fiancé to be a proof that I won't be a public chanrge... the embassy accepted that... then they ask me to pay a visa delivery fee and instructed me to just wait.. they will review it and just notify me if they need something else or I will just received my passport... at present I still don't hear anything from the embassy... we email the embassy to see where my case at this time they reply that it is still in the consular officer for review...
    Do you think they will honor that 2007 ITR?or they will still go to their first decision since I didn't able to give the 2007 at the time of my interview..
    Its almost 3 weeks now after I passed that ITR 2007 and the bank statement..
    Is there any other way to challenge their decision?

    You should have your attorney follow up on this matter on your behalf.
    As a matter of fact, he/she should have told you to get joint sponsor before filing I-130.

    If you have an attorney let him do it but if you want to do it alone all you can do is wait because as you can see lots of applicant in the embassy and for sure you are not the only one have this kind of problem, they might have 1000 applicants for review so it will take time for them to reply since they are entertaining first come first serve basis.
