My children father and I are not married but we have two children. He only provide support for my children if we are together. We are no longer together and he wants nothing to do with my children, my two year old go through an emotional state every time his father leaves his presence and he don't see him again until he want to bothered which can be months or weeks. I don't think it's fair to them, they can have a much healthier life if he wasn't around and I would like to get his rights taken so he can't come around when he feels like it.

Hate to be the bring you down but you can't. What you can do is go to court to get a support order in place that way he will pay a certain amount each week (or month sometimes) and if he dosen't the court can hold him in contempt. Also you can have a visitation schedule set up if he wishes that way he has specified times that he can see them (and it won't be a surprise visit to you). He can choose not to exercise his visitation rights but at least then you will know when his visits should be and you can keep a log of all his keept and missed visits to use as evidence for future hearings. But as far as taking his rights there isn't a judge in the country that would do it.

Well first, what is the legal custody agreement that you have.
What is his current legal status with the children,

What is the current court ordered child support, and have you turned him over to the state child enforcement authorities. Have you asked the court to order a garnishment of his pay check for child suport?

But seeing the child every few months will keep him in contact enough so that it is most likely no rights could be taken away.

Also if he only sees them when you are living together, how often does he move in and out of the house?

You need to set up everything officially in court first

If you don't want him coming around when HE feels like it, go to Court and get an Order for visitation (and support) and there will be limits and it will be in writing.

Depending on many other factors you "probably" cannot simply get his rights taken away.
