Ask Me Help Desk - Child support increase

What will I need to do to get an increase in my child support order? I originally was receiving $75.00 wkly. until my ex had an automobile accident and couldn't work. The amount was dropped to $63.50 wkly. however; he is back at work making more than me and our son still only receives $63.50 wkly. and he does not do anything for my son or even come to visit him. Our son is 10 years old and wants to partcipate in sports and other things that interest him, he is a straight A student and highly thought of by his school and all of his teachers.I don't have attorney fees to take care of this matter and we need help to provide for his needs. He is entering middle school and he needs are increasing.Thank You, in advance.

They can tell you how you can go about altering your child support amount. You will have to go back to court and request that the order be changed. You don't necessarily need an attorney to do this. (Don't yell at me for saying that, Judy! Ha ha)...

Okay, I won't yell, at least not this time. Can I mutter under my breath?

Some things can be done by Attorney (or are better done by Attorney) and some are not. If you've got your proof together, can present a good case - certain Courts are very "user friendly." Doesn't look like this is an enforcement matter - I think the father is paying as ordered, just never had the order raised after he went back to work. Looks like Family Court (or whatever it's called in your area) is the place to go. If you are very lucky your State sets support by Statute so there's not a big argument.

But if you don't have your proof together - you get one chance and if you fail... well, you had your one chance.
