    Tricked into marriage for citizenship
I know some one who was treated like a king, thought he was in love and was tricked into marriage. After her permanent visa came in she made false domestic violence complaints against him and is using all kinds of battered woman programs to take him for a ride. She got him kicked out of the house and threatening to sue for alimony. He what can he do to get out of this situation. Does she have him by the you know what's? Or is there an honorable way out of this ?

I have been working in this area long enough to know that when someone raises an issue like this one, don't jump to a conclusion without hearing the other side of the story. Sometimes guys are stupid enough to put themselves in troubles and sometimes guys want to take advantage of those women who want green card and many ends up in domestic abuse, etc.

There are ways out but you have to provide more details.

He wants nothing to do with her, and more importanly he want no to take no part in making her a citizen. Is filing for devorce the answer to her visa being rejected?

Oh I forgot to mention, she is harassing him to move back in with her, because I believe they have to live together for at least 5 years, or something to that nature, I'm not sure how much time they have to live together before she is free and clear, but they are not living together and its only been 2 years since they got married. She just got her working papers right before the domestic violence complaints were made. Does this kind of issue sound too familiar to you?

What is a permanent visa anyway? Is that the same as being a citizen? Or does this visa expire? What are the conditions of maitaining this visa valid?

In process of becoming permanent resident based on marriage with US citizen, one has to be legally married. Alien spouse will be given a 2 year conditional green card and will have to file removal of condition by the end of the 2 year term. If the couple are still married, live together and provide supported documents such as joint bank account, joint credit cards, joint lease/mortgage, tax return filed jointly, etc.

If the marriage ends prior to this 2 year term, the alien spouse will lose his/her legal status, except there is domestic abuse which the alien spouse could file self-petition to become permanent resident.

If your friend feels he is being used, he can file for divorce or even annulment. He can also submit letter to USCIS to withdraw Affidavit of Sponsorship he signed which simply means to inform USCIS that he no longer remain in relationship with his alien spouse. At this point, she may face removal if someone reports to ICE.

But for the short term if she is making false police reports, he needs to keep away from her, and do any contact though an attorney.

Marriagees go down hill, citizen or not, so many go back during thefirstw two years it is hard to tell if it was fake to start or not, So in all aspects of life, one has to stop worring how to get back at the other person, or what will happen and move on with their own life, if they don't they will become obsessed

I think I was tricked, fooled and foolish to believe and fall for this very pretty asian woman. We chatted for a year before I went to China. She kept all her chatting records a secret. She wanted to marry, and I want to start a new family including adding a new baby to the family. She agreed. We married. After a long time waiting for her to get to USA. She made it finally and then her story changed. She will not have a child, does not want to work, and does not want to open a business together. She left to another state when I was at work. And has not called. She was only here with my little girl and I for 40 days. NO! There was no abuse. That's not all. She would get mad because I would wakeup early and she could not get her sleep. She woulld make my little girl late for school because she was always rushing. She cared more about her looks than my little girl or I. So, it seemed that way. It has been one and half days now that she left. My little girl called her "Mom". Because her real mom has never been there for her. This hurts me more than anything else. My little girl has 2 moms now that don't love her. Yes, I have custody of my little girl. She is 6 yrs old and I have had her alone for over 5 yrs. What am I to do about my situation with this chinese woman?

You will get more responses if you post this as a question and not an answer to a 3 1/2 year old thread.
