Hello all, This is a very stressful situation for me.
I was originally on unsupervised probation from 2001 to 2006. At which time I was released and unable to complete the 1st offenders treatment for full payment of restitution.

Unknown to me the probabtion office had placed a probation violation warrant for me a month before I was due to be released from probation for non-payment. I was picked up on the warrant April 6th sent to jail for 5 days and went before the judge who extended my 1st offenders treatment for 6 more months, released me on ROR, and continued probation unsupervised. Once paid - I am done! And record can be cleared.

However, I contacted the probabtion office the following Monday and was told they would NOT release the original warrant UNTIL I had made the final payment, which leaves me paraniod that if I am pulled over durning this time I will be re-arrested. Is there anything that I can do to get this lifted? This does not seem legal - its like blackmail.

There is no term for "lifting" the warrant. You've already been arrested on it and released. You won't be arrested again on the same thing.

Yes, probation officers are pricks. What did you expect??

The Atlanta police WOULD indeed arrest again and not care. Probation stated to keep a piece of paper with me and have the officers call their office if something happens. HA!

Of course, if you called the cops and asked them if they'll arrest you on a warrant like this, they'll say yes. The cops are pricks too.

By the way, if you HAVE a warrant, why didn't the cops tell you to turn yourself in??

Look, you don't have a warrant. IT was satisfied. They're not going to tell you the truth. They suck big time. Besides, you're worried about things you have no control over.

You DO have control over whether you are pulled over or questioned by the cops about anything. Just DO what you have control over, then you'll NEVER have to worry about the things you can't control.

Just pay them the final payment as soon as possible to get them out of your hair. What's the problem with doing that? That's part of probation and you did not complete the payments so they opted to extend the probation. Be happy you didn't have to go every month and miss work and see the PO in person and put up with that headache. Paying money to end this is the only answer. The sooner you pay the sooner you don't have to worry about a warrant. And, yes, they can arrest you if it is still in the system. Cops just do their job. They don't care if you have already been arrested for the warrant. If it's in the computer they don't argue with a machine.

Ok, once you are arrested and taken in front of a judge that satisfies the warrant, If they want you arrested again they have to issue a new warrant.

If there is a warrant, The police don't read any paper or call anyone other than the agency that has the warrant out. They will decide if you will be detained more than 20 minutes. But a warrant is issued for a reason, and if there is a warrant the probation officer has a obligation to arrest you when you report to them also.

Sounds like they are messing with you, telling you there is still a warrant, PO's like to mess with people because they can.

To all that replied, you are so CORRECT! As soon as I return - they will be getting the final payment in whole. I know this is the only way to move pass this oppression called law enforcement. I have had this hanging over me for the past 7 years. I understand now that probation for me is a collection agency with a badge.

My only concern with the warrant was that it seemed illegal to my civil rights (blackmail anyone) but NO matter as all have stated - PAY IT and move on. Driving with awareness is the new fashion style, at least, until payment has been made and I can just fight the ticket and not the jail system.

Just an end note: contacted the probation office to inquire as to the process once I make the final payment - they indicated that they must called down to the payment area and tell them to "accept my payment and not detain me" Ugg. What idiots. You have to call someone to have them accept a payment and not arrest me! When you are the ones who have placed the very warrant.

I also wanted to know that once they receive payment if they will remove the warrant right then and there, she (the supervisor) did not know. Also wanted to get before a judge that day to show that I satisfied the 1st offenders treatment - she also did not know if this would be possible. So I will be taking an attorney with me that day to try to have everything accomplished the same day of payment hopefully.

Do I get check for warrents before getting released from probation?
