I recently moved to Florida in October, I rented an apartment and have had numerous concerns with the landlord. In the lease agreement it states I am responsible for a third of the utilities only to find out after I moved in that I have no control over the heating or cooling in the apartment. The landlord enters the apartment whenever I am not home, when I asked her to please stop! She retaliated by leaving my mail on the ground in front of my door instead of waiting for me to come and get it from her. I have no mailbox. I travel a lot and she has no idea when I will return. They live over me and are very early risers. They are very nice people but How can I break my lease with the implied intent this is not a good fit for either of us.

The LL certainly appears to be irritating but may not have violated any terms of the lease. The utility issue is not grounds to break the lease, possibly you did not read or ask about all the details about the heating, I don't know this for sure. Entering the place when you are not home is a no no unless the LL has a specific reason to enter such as a leaking pipe or broken window, something maintenance related. Can you give us a quote from your lease regarding what it says about the LL inspection or visiting the unit? Thanks

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

What does your lease say about access to the apartment? Except for entering the apartment without permission, you have no real grounds for breaking the lease. The entering MIGHT be enough if they sue you, if you can prove it.

As for your mail, get a PO Box.

Let's see - what does your lease say about the LL entering outside of an emergency? "Most" leases say 24 hour notice -

It's too late to address the heating/cooling problem - this is something you would have responsibility for noticing.

Throwing your mail on the ground is upsetting but not illegal - unless she's getting her hands on your mail on some illegal fashion. I'd buy a big mailbox, install it, buy a lock.

Has them "rising early" become an issue? It is not illegal nor does it break your lease.

"Good fit" is not grounds for breaking a lease - unless you can both agree and sign off.
