    Can the legal description of a stand alone condominium unit include the exterior walls

    ABSOLUTELY! The Condominium Laws, often called Horizontal Property Acts, have been in enacted in EVERY STATE in the US. Under these laws, the occupant/owner of each apartment hold a fee simple title to the apartment and also a specified share of undivided parts of the building and land, known as the "common elements". The unit owners in the condominium own these common elements together as tenants in common. The condo may range from freestanding highrise buildings to townhouse-like arrangements. The common elements include items such as the land, EXTERIOR STRUCTURE, hallway, elevators, stairways and the roof. Anything else on this, please get back with me... I am a Realtor and pulled the info directly from my Real Estate "bible".
