How long before I am evicted?
I am losing my house to foreclosure and wanted to know if I have any legal rights as to how long before I am kicked out. I don't want to sheriff showing up in my doorstep. Am I allotted a time frame or is it up to whom ever purchases the house? Will I be notified or will someone just show up and say get out. I live in Kentucky Please if anyone has any answerrs!!

Most of the time, you will be given a time frame by which you have to vacate. You may be able to negotiate with the new owner on what that time frame is, especially if the new owner is a lender. Once served the initial notice to vacate you can fight it in couirt to get more time, if needed.

Thank you for your help do you have any idea what the time frame usually is... a few days, a couple weeks, a month? Is there any set guidelines to how long we are allowed?

No, it can vary from area to area. It depends on how the foreclosure is processed, whether there is an immediate auction or not or whatever.

Have you considered making an offer on the house? If the landlord is going to lose it anyway, you might be able to get it for a small amount. You may even get the lender to transfer the mortgage to you and you just pay the arrears.

I am the homeowner, we bought the house a couple of years ago.We almost lost it last year but was able to come up with the rearrages and was OK. Everythig has gone downhill again and they aren't even giving us the option to make the balance current. It goes up auction on May 6th. I have 2 small children and need to make sure I have found a place to live before I get thrown out. How can I find out what the laws are.

Sorry, we just had a spate of questions about tenants rights in a foreclosure and I got your question confused.

Check with your local courthouse, they should be able to give you an idea. But most laws say you have to vacate as soons as you lose the house. Most of the time the people foreclosing or the people who buy the foreclosure are more understanding and will give you more time.
