What if you don't have a operating agreement in place but I do have my name listed on the company's bank account. Am I legally recognized as one of the owners? I am from the state of Virginia.

No, plenty of accountants and bookkeepers have authority to sign checks, have their names on the bank accounts. Doesn't make them part owners.
