Filing taxes on an OPT Visa
    Hi,

I graduated from college in May 2007 and moved up to New York City in August. I've been working steady since November on an OPT visa. Since I'm on OPT, do I file for my taxes as a non-resident? And which tax forms do I need to fill out exactly?

    Thanks

When did you enter the U.S. on F1 visa. On F1 and OPT you are nonresident for 5 years.

I entered the U.S. August 2003 on an F1 visa and graduated May 2007. My OPT start time was June 3rd 2007, and I've been working under it since November 5th 2007. I was checking all the forms and I think I've got it figured out. Since I have not lived here more than 5 years, I am a non-resident. That means I need to fill out two tax forms only, the 1040NR-EZ and Form 8843. My employer did not withhold any SSC or Medicare expenses. I've only received a W2 from my employer? So am I right in thinking that I only need to fill out these 2 forms, or will I have to do more?

Thank you so much for getting back to me!
