    do I still need to fill tax forms when there's no W2 form for me?
    I got my 1042-s form but I don't get W-2 form. I went to payroll office and they told me there's no tax information on me in the computer which means I will not have W-2 form this year. My question is that do I still need to fill tax forms before tax day, because I received 1042-s form?

    Here's my information:

    I'm a J-1 visiting scholar. This is the third year I'm living in U.S, so I'm still eligible free of paying any taxes. Before April 2007, I was paid only by my home country. After that, my boss in U.S. began to pay me. Through whole year of 2007, I did not pay any taxes.

    Are you a Professor, Teacher, Researcher, Student or Trainee? What is your citizenship?
    Even if you are exempt form paying taxes, you must still file Form 8843 alone or with your tax return.

    1042-S is issued for various purposes? Scholarship, personal services,. What type of income you received? Or what is the code in box 1.

    I'm an exchange student. I think I should be classified as Researcher. The citizenship is non-resident. 1042-S is issued for "compensation for teaching".(the code in box 1 is 18)

    What country are you from? Depending up on this, check the tax treaty based on your clasification.
    Also what is the code in box 6 of 1042-S?

    I come from China. The code in box 6 is 4(interest paid by foreign corporations)

    Box 6 code 4 means exempt under treaty.
    If you are a researchers you will file Form 8843 even if you don't file your tax return.

    Thanks a lot! One more question. Does my spouse also need to file form 8843 even she doesn't have any income here?
