My daughter was involved in a 3 car rear end acc. The first car was stopped in traffic, at a long back up at light ,the numder two vehicle very abruptly stopped just nicking #1 but causing daughter to run into her. Her following distance was of course a little to close but I do think that the law in tenn does consider nature of rear in collissions, damage was minor to 1st vehicle, and 2nd needs bumper , my daughters major due toe 2nd vehicle was a SUV and ours little car which hit in a way causing more damage, not due to speed. Is the number 2 vehicle liable for her own repairs or are we responsible for it no tickets issued

As I understand it, car #1 (first) lawfully completely stopped. Car #2 stopped (whether she was on her cell phone or not, she stopped and did not hit #1) behind #1.

Your daughter in Car #3 hit Car #2 in the back, forcing number #2 into #1. I will be surprised if #1 doesn't also look to your daughter to pay for the repairs because she had no fault, #2 had no fault (was, in fact, stopped) and your daughter forced #2 into #1.

You say that speed was not involved and I don't know how close together the cars were but it's difficult for a "little car" to push an SUV forward and cause damage to the front car unless some speed is involved.

Your daughter is responsible. She was travelling too close and didn't have sufficient control and time to stop. Number 2, cell phone or not, managed to stop.

It would be different IF #2 hit #1 and then your daughter hit #2. But that is not the scene as you describe it.

In a rear end collision the collider is almost always at fault. No matter why Car #2 stopped, whether its was because it hit Car #1 or not, Car #3 hit it. In this scenario Car #3 is at fault because it was traveling too closely. Otherwise she would have been able to stop in time.

Agreed - also #1 was stopped in a line of traffic and #3 should have been aware of what was happening in front of her.
