Should I use 1040NR or 1040NREZ in this case?
If I have a 1099 INT that erroneousely mentions savings account interest income and tax withheld on that, can I use the 1040NREZ to file? I am a non-resident alien, so the interest should be exempt, but my bank sent me the 1099 anyway.

Basically, I cannot report interest income on the 1040NREZ, (which should be fine since the interest is exempt or non-taxable for me) but can I still claim the withholding on that? Also, do I need to file the 1099INT along with the 1040nrez?

(my tax software is automatically generating a 1040nrez)

You can file Form 1040NR-EZ. Don't report interest but do add federal tax withheld. Normally you don't attach 1099-int, but in your case you should attach it.

I think, you need to use 1040 NR..

You need to mention the interest income on page 5 -> L of 1040 NR

Add the taxes of your W2 and 1099 INT -> Federal income tax withheld line 59
