    Overpaid resittution money did not go to court fines
    I overpaid restitution by a couple of grand. Probation officer did not allocate funds to go to court fines. Filed a motion to lien fines, but judge let me off probation saying "enough is enough" but neglected to rule on motion to lien fines. Recently received a collection letter from the courts, they want me to pay over $7,000 in court fines:eek: . What can I do now? Can I file another motion to lien fines? Can the over payment of restitution go toward court fines. Thanks.

    Yes you can still file that motion, and yes it can if the judge so orders.

    I don't know. What difference does it make whether you owe $7K or $5K. Frankly, I'd be worried about the $5K I didn't have rather than the $2K that I think should be credited.

    The good news is that your case is now in CIVIL court where if you don't pay, all they can do is award a judgment... When you were on probation, if you didn't pay, they could have thrown you in the slam.

    I'd be counting my chickens..
