    Question about Florida probate law
Here in Florida if a married couple who own a home in which only the wife is on the title deed , if the wife died would the estate go to probate or would the husband assume the ownership without going to probate.

I am 80 percent sure it will have to go to probate unless she had a will.
Probate is not a "bad" thing, it does not mean tax will be paid it only means that a judge will have to rule on ownership and division of property.

But the best bet is to go to an attorney who specialises in probate. If it can be transferred without it, they will know how to file it.
