    Again tree roots.
I have a huge maple tree on the border of my property. And have two concerns. Roots of this tree extend to my neighbor driveway. He plants to cut them out completely and put a new driveway (which starts 1ft fromtrunk). I am afraid that this will make tree weak and since it leans toward my house will eventually fall on the house. And second, huge branch (1.5 or 2 ft in diameter) hangs over my roof. I am thinking of cutting it out but also I read that so drastic action can cost some trouble. So between roost cutting on one side and branch cutting on the other (opposite) what my action should be?

You should check with your city / town, sometimes trees are protected and your neighbor may have to work around the roots or minimize the damage. You should also hire a arborist to advise you. Cutting half the roots will affect the tree.

There may also be an easement in the property deed that keeps him from constructing within a certain amount of feet from the property line.

Thank you all for answers. To give more light on the situation. We bought the house last year and after couple windy nights we know we have to trim the tree. But our neighbor plans are a little scary. The driveway already exists. He just want to replace broken concrete. He told us that somebody ensured him that cutting roots will not do any damage to the tree. In my opinion it is not true since these are the feeders roots but I am not a specialist. On the other hand if we cut this one branch it will be nearly a half of the tree.

I really think you should get a specialist to advise you on this, there should be an arborist in your area. They may be able to do something that will help the tree survive.
