    Filing form 1040 dual status tax year 2007
    When filing form 1040 for dual status tax year, do I claim my dependent for the whole year. Do I also claim charitable contributions and HSA for the whole year. Then fill out form 1040nr using figures that relate to the non resident part of the year?:confused:

    Please tell more about the dependent. Are you taking about your spouse?

    You will not get standard deduction on Dual status return but you will get itemized deductions. Check schedule A (form 1040).

    My dependent is my daughter who is in full time education. R2 Visa. I am on an R1 Visa

    Yes, on your dual status tax return, you can claim exemption for your daughter. You can also claim Tuition and fees deduction.
    Read Publications 519: Tax For Aliens; page 31, column 2 (top).
