    US India tax treaty + Exemptions
    Hello,

    I am filing 1040 NR and can I claim $5350 under US india tax treaty (Line 22) along with $3400 standard exemption(line 39)? Even though I put in $ 5350 under line 22 it is not getting deducted anywhere!! Am I missing something? Can anyone please help?

    What is your current visa? When did you enter the U.S. and on what visa?

    What do you mean by it is not getting deducting? Are you using a software? Which?
    Note that most software don't do nonresident tax return.

    I entered US on F1 visa (entered on Jan 05,Indian) and now I am on H1B visa. I got changed from F1 to H1B in 2007. I am not using any software, just doing it manually. I put $5350 on line 22 of 1040 NR and $3400 on line 39. What I meant by 'not getting deducted' is that 1040 does not deduct $5350 if I put it on line 22. I think I may have to show that amount somewhere in Schedule A (itemized Deductions), but I don't know here to record it. Please help.

    You will put $5,350 on schedule A as standard deduction as per tax treaty and then on line 37 (itemized deduction).
