    Charge off debts and collection agencies
    I am in the process of filing Chapter 7 Bankruptcy. After I had my document preparer fill out the documents I found out that several of the debts had either been "charged off as bad debt" or sent to collection. What I need to know is do I need to file an amendment to my bankruptcy court papers listing these new "creditors" (aka: collection agencies) or are the original creditors enough. I asked my document preparer (but of course she can't give legal advice), however she said I don't owe the collection agencies, I owe the original lender, so I should be fine. I just want to make sure of this because after my creditors meeting and if my bankruptcy should go through, I don't want these other people coming out of the woodwork saying I owe them money because the original lender sold them my account. Can anyone give me some advice on what I should do or how I could find out this answer, because I can't afford legal council.

    List them regardless of what the document preparer says. This way you are covered in case they do decide to come after you. Just because the debt has been charged off as a bad debt can still be collected on sometime in the future. Since you are going to the trouble and expense of filing a bankruptcy a little more paperwork is not going to hurt. This way you will be truly starting clean once your bankruptcy trustee's meeting is over and you receive your discharge papers.
