Has anyone been through this situation, I have raised my grandson all his life, he is now 13 and again this year I found out that his mother, my daughter has claimed him once again on income tax, this is not allowed, the boy has never lived in her home and she does nothing to support him, I live with a man that has taken care of him for around three years now and he just found out this year that he can claim him, he tried last night on the internet and it said that someone else has claimed him, it has to be my daughter, can anyone tell me what I do, I called the IRS but I don't understand what they need me to do, can anyone tell me what I should do, or ken rather, does he file for the boy, if so what paper needs to be filled out, please let me know, thank you

The requirement to claim the child are:
1. The child must have lived with your for more than half of the year
2. The child did not provide more than half of his or her own support.

Main point to note is that who ever has custody of the child (lived with more than half of the year) can claim the child even some other person provided support for the child.

If the man you live with qualifies to claim the dependency exemption for your grandson, you should file the tax return on paper. The IRS will then contact you and/or your daughter because only one person can claim him as a dependent. Next year file early before your daughter does and she will get the same message that you got.
