    Hi

    I have a few questions

    I was on an OPT till the end of May and had applied for an H1 which got approved in October 2005. Do you think I should get W2 form for my OPT status although I was not having job in hand till Oct 2005.
    Which are the forms I should use for filing my tax returns. I came to USA in Jan 2002 on an F1 visa and am presently working on H1 visa. Should I be filing 1040NR-EZ or 1040NR.

    You are a dual-status alien. You can file the dual-status return or wait until early June to file as a resident alien under the First Year Choice.

    Thanks for your prompt reply.
    Well I am not able to understand. You mean to say I can file the form 1040NR-EZ. In that case in the itemized deduction line what value should I enter and what value should I enter for exemption deduction. I am a citizen of India. Also can I claim any taxes which are withheld.

    My F1 status ended on May 31st and H1 status began on Oct 19th.

    If you lived in the United States for the entire time from June 1st on, then you must file as a resident alien, as you qualify under the Substantial Presence Test. Use tax software and enter the data from your W-2. The software will calculate the taxes for you.
