How can I get a court order for dna testing for 16 yr old who might be my grandchild. Her mother had moved after the child was born. She had pursued dna testing and at that time my son was in critical condition from a drunk driver who went onto the shoulder of the road and hit my son while he was working. I didn't want to be bothered with the dna because my son was my priority. I believe the child is his. Another girl pursued dna testing about 4 yrs later and this time I wanted it done and also wanted dna for the first girl but she had moved because someone told her I was going to try to get custody of her child which was not true. I finally located her about 3 weeks ago and still want to do the dna and she wants it too. My son has died since the last dna and all the files of lawyers and the lab who did the testing have been erased. The second child's mother disappeared after the inheritance from my son went into a trust fund for her child. How costly is it to get a court order for the testing. I know who the trustee is and can get her address from the court that way. Or would it be cheaper to do a family testing from myself and my daughter. I know it would not be as accurate but I live off disability but make too much for legal aid. I feel I owe it to the mother because I wouldn't do it in the beginning and she has raised this child herself with no help. I told her I would pay for the dna testing.The mother of the child who did get the dna testing from my son when he was still alive thinks her child should be the only child to inherit from my son therefore she is not willing to let her son be a part of the dna testing. I am sorry to say but she carries greed within herself and does not like the other girl (who are women now). So without a court order she won't allow it. Like I said above she has not let me know when and where she is at this time. So I wanted to know how costly it would be to get a court order and what the procedures would be. My son's name is not on the birth certificates.

1) If every one agrees then you don't need a court order just to do DNA testing.
2) what is the real problem here ? Are they liking to ajoin themselves to the estate ? Is your sons name on the birth certificate ? If so then they ( the children ) may be entitled to survivors benefits from SSI. That's another reason for DNA testing.
