    My Grandfather retained mineral rights on property he bought and sold in Arkansas over 40 years ago. My father and his parents passed away 20 years ago. We were informed that we will be getting a lease check for them, they will be drilling for oil. My real mother passed away 45 years ago. My stepmother (she did not adopt us) has been remarried 19for years. My question is: should she be entitled to this check also?

    If she is divorced from your father before his death, no she would not be.
    If she was married to him at his death, she would have been the heir and would have gotten her share of his estate.
    These rights should have been settled there, as to who owns them, if not, the matter may have to go back to probate court.

    What did the Will say? What did the final probate papers say?

    Whether your stepmother adopted you is immaterial - if she was the legal wife at the time of your father's passing, she's entitled. In fact, in many States she would be entitled to everything and the children/grandchildren would be entitled to nothing.
