    Garnishing my sisters Taxes
    I co-signed a car for my sister that went into repo, threw a small claims judgement that "we" owe on now and she ran off to another state to try to get out of it and she is very hard to keep track of. I filed a small claim against her because I have been the only one paying on the car for the last couple years and I never drove it or had anything to do with it except I was stupid enough to co-sign on it for her. My question is I went to court and sued her for the total we owe the bank and was granted judgement now that I have a judgement against her and it says she owes me $X amount how do I garnish her wages, her taxes and her bank account to get the money she owes me. I live in Idaho she lives in California.

    You need to go to court and get a judgment against her to garnish her.

    Yes you can garnish her wages and bank accounts, no you can't garnish her tax refund.

    But you have to get a judgement first and you have to find out where she works and banks.

    I don't know if it's worth the money but some collection agencies will collect Small Claims Judgments from one State to another. They have the ability to obtain the necessary info on your sister, know the procedure, can possibly make it fast and easy.

    I like Small Claims Court for most things but when you are dealing with one State and then another it gets complicated and frustrating.

    How did you get a judgment against her in Idaho if she lives in California? Or aren't we talking Small Claims? I'm in NYS and have a matter (Defendant) in Maryland and I'm pretty much running in circles.

    And Scott is right - you cannot take someone's tax refund.
