    Does my husband still have to pay child support if he gives up his rights?
    My husband found out today that his job has to fill out paper work for child support the thing about it is that the child is 12 we live in TX and she lives in AZ. He is not on the birth cert nor never seen the child nor has he taken a DNA test. If he gives up his rights will he still have to pay child support even if he has 3 children of his own with me? He got served with papers back in 2003 but it never went through.

    Welcome to AMHD. Your husband has an unresolved, legal issue. Until he proves that he is not the father, or a court terminates his parental rights, he will pay child support. It doesn't matter if he lived on the Moon. Try to get him some help.

    If you bothered toread the hundreds of threads including the sticky note in this forum you would have found your answer.

    The bottom line is that courts will not allow a parent to relinquish their rights to get out of child support. Depending on the state you are in, either the courts will not allow your husband to relinquish his rights, or, if it does, then it will not affect his obligation to support his child.

    That being said, why hasn't he had a DNA test?
