    Hi there,

    Here is my situation: my OPT started from May 2006-May 2007. My H1-B started from Oct. 2007. I hired a CPA to file the tax for me in 2006 and 2007 w/ the form 1040. I just talked to my friend and she said in my situation I should file form 1040NR instead. So what should I do now? I already got the tax refund for year 2007.

    My friend also mentioned that when I was under OPT my employerand I do not need to pay the medicare and social security tax. She said I can filed the tax return to get the money back. But if I file the wrong form in the first place, can I still get the refund? Can I hire somebody to take care all this for me?

    If you are single, for 2007 you will file nonresident tax return. Now you will need to file 1040X and properly done nonresident tax return. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents
