    Really being sued or scare tactic?
    I received a letter today from an attorney that is representing Capital One. The letter states that "A lawsuit is being filed against you...You should be receiving a summons and complaint from the court in the near future". Along with that letter is another document that has the letterhead from my local judicial district court; although there is not a case number and there are a few blank lines. At the bottom there is the standard "This law firm is a debt collector attempting to collect debt for our client and any information obtained will be used for that purpose". I can't tell I am actually being sued or of this is an elaborate scare tactic... any one have experience with this?

    I live in Michigan and the law firm is Weltman, Weinberg, and Reis. I did look up the name and he is an attorney.

    Also, I heard somewhere that you can't be sued by a debt collector, it has to come from the credit card company directly. Is that true?

    If they assigned the debt to the attorney, he has the right to sue you.

    It is probably not a scare tactic, but an attempt to get you to communicate with them before they actually file the suit.

    If you do nothing, you will most likely be served with the notice of suit and a court date or a date in which you must file an answer by.
